Acceptance of Terms

By accessing and using the services provided by Vitron B.V. ("Vitron", "we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and Vitron regarding your use of our personal training services, website, and related services.

If you do not agree to these Terms, please do not use our services. Your continued use of our services after any modifications to these Terms constitutes your acceptance of such changes.

Service Description

Vitron provides personal training services including but not limited to:

• One-on-one personal training sessions
• Small group training sessions
• Nutrition coaching and meal planning
• Fitness assessments and progress tracking
• Specialised training programmes
• Lifestyle and wellness coaching

All services are provided by qualified and certified personal trainers at our facility located at Vijverweg 31, 3528 PL Utrecht, Netherlands.

Eligibility and Health Requirements

To use our services, you must:

• Be at least 18 years of age, or have parental consent if under 18
• Complete and submit a health questionnaire and liability waiver
• Disclose any medical conditions, injuries, or physical limitations
• Obtain medical clearance if required based on your health assessment
• Follow all safety guidelines and instructions provided by our trainers

You acknowledge that physical exercise involves inherent risks and you participate at your own risk. It is your responsibility to consult with a healthcare provider before beginning any exercise programme.

Booking and Scheduling

Training sessions must be booked in advance. Our booking policies include:

• Scheduling: Sessions are scheduled based on trainer availability and your preferences
• Cancellation: Cancellations must be made at least 24 hours in advance to avoid charges
• Rescheduling: Sessions may be rescheduled subject to availability
• Late Arrival: Sessions will end at the scheduled time regardless of late arrival
• No-Show: Failure to attend a scheduled session without proper notice will result in full charges

Payment Terms

Payment terms and conditions:

• Payment Methods: We accept various payment methods including bank transfers, credit cards, and digital payments
• Payment Schedule: Payment is due before or at the time of service unless other arrangements have been made
• Package Payments: Training packages must be paid in full upon booking
• Late Payments: Late payments may result in suspension of services
• Refunds: Refund policies vary by service type and are detailed in your service agreement
• Price Changes: We reserve the right to modify our pricing with 30 days' notice

Client Responsibilities

As a client of Vitron, you agree to:

• Provide accurate and complete health and contact information
• Follow all safety guidelines and trainer instructions
• Arrive on time for scheduled appointments
• Maintain appropriate personal hygiene and wear suitable workout attire
• Respect our facility, equipment, and other clients
• Notify us immediately of any injuries or health changes
• Make timely payments for services rendered
• Treat our staff and other clients with respect and courtesy

Facility Rules and Conduct

To ensure a safe and positive environment for all, the following rules apply:

• No use of equipment without trainer supervision
• No food or drinks (except water) in training areas
• Mobile phones should be on silent mode during sessions
• No photography or recording without explicit permission
• Appropriate workout attire and closed-toe shoes required
• Personal belongings are your responsibility
• Report any equipment issues or safety concerns immediately

Intellectual Property

All content, materials, and intellectual property provided by Vitron, including but not limited to workout plans, training methodologies, nutritional guidance, educational materials, logos, and proprietary systems, are the exclusive property of Vitron and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use these materials solely for your personal fitness goals. You may not:

• Reproduce, distribute, or share our proprietary training materials
• Use our intellectual property for commercial purposes
• Reverse engineer or copy our training methodologies
• Remove or modify any copyright or proprietary notices

Privacy and Confidentiality

Your privacy is important to us. We collect, use, and protect your personal information in accordance with our Privacy Policy and applicable data protection laws including GDPR. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

We maintain confidentiality regarding your personal health information and training details, except as required by law or with your explicit consent.

Limitation of Liability

To the fullest extent permitted by law, Vitron and its trainers, employees, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of income or business opportunities
• Emotional distress or mental anguish
• Failure to achieve desired fitness results
• Equipment malfunction or facility issues

Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.

Indemnification

You agree to indemnify, defend, and hold harmless Vitron, its owners, trainers, employees, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or related to:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Any false or misleading information you provide

Termination

Either party may terminate the service relationship at any time with appropriate notice:

• Client Termination: You may terminate services at any time with written notice
• Vitron Termination: We may terminate services for breach of terms, safety concerns, or inappropriate behaviour
• Refunds: Unused portions of prepaid packages may be refunded according to our refund policy
• Effect of Termination: Upon termination, your access to our services and facilities will cease

Termination does not relieve either party of obligations incurred prior to termination.

Force Majeure

Vitron shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, strikes, or other unforeseeable events. In such cases, we will make reasonable efforts to resume services as soon as possible.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

Modifications to Terms

Vitron reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for any changes.

Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Vitron regarding your use of our services. These Terms supersede all prior agreements, understandings, and communications, whether written or oral.
